Happy Whole Human (HWH) Coaching and Education

1. General Disclaimer

Happy Whole Human® (HWH) coaching is designed to support personal growth and well-being but is not a substitute for professional medical or psychological treatment. In case of a medical emergency or serious mental health issue, clients should contact emergency services or visit an emergency room. HWH strives to provide quality interactions and information but does not guarantee the outcomes or accuracy of information in its products and services.

2. Responsibility and Liability

Clients agree to hold Dr. Lisa Leit, HWH-certified coaches, and HWH harmless for any health issues they or their representatives may experience. Clients are responsible for their own decisions and actions, and HWH does not provide medical, psychological, diagnostic, or treatment services. If clients are experiencing severe mental health issues, they are required to be under the care of a primary physician or psychiatrist and sign a waiver for collaboration with medical professionals. Coaching is not a treatment for illnesses, and only qualified healthcare professionals can provide accurate diagnoses.

3. Medical Advice and Support

HWH representatives do not act as doctors, medical professionals, therapists, or dietitians and do not offer clinical, medical, or psychological advice. Clients should seek medical advice before starting any health-related program. HWH products and services aim to support a healthy lifestyle and are not intended as medical advice.

4. Coaching Philosophy

HWH coaches do not direct clients on what to do or how to do it. Instead, they facilitate clarity, provide resources, and support clients in exploring their challenges and goals. Coaching sessions may be conducted by any available HWH coach to ensure a consistent experience.

5. Coach-Client Relationship

The relationship between coach and client is collaborative, with the coach guiding the process and measuring progress based on the client's self-discovery and ability to handle life's challenges.

6. Goals and Sessions

Coaches may suggest session goals, but the final decision rests with the client. Clients are expected to be proactive in setting and pursuing their goals.

7. Cancellation Policy

Clients are expected to honor scheduled appointments. A grace cancellation is allowed once. Subsequent no-shows or cancellations within 24 hours will result in full charges unless another session fills the slot.

8. Communications

Coaching may involve personal projects, business achievements, or general life conditions. The coach acts as a facilitator, and the client is responsible for implementing changes.

​

9. Confidentiality and Privacy

Clients must provide accurate information and disclose any mental health issues that arise during coaching. They have the right to opt out of discussing specific topics or participating in exercises.

​

10. Mediation

HWH coaches may act as mediators in disputes, maintaining confidentiality and ensuring a fair process. If mediation is not pursued in good faith, it may be terminated without a refund.

11. Payment and Refund Policy

Fees are non-refundable and due at the time of service. Prepaid packages are transferable but expire after one year. HWH reserves the right to discontinue coaching if it is no longer productive.

12. Agreement to Work It Out

Clients and coaches agree to communicate openly and work together to address any issues in the coaching relationship.

13. Termination

Both parties agree to provide two weeks' notice if they wish to discontinue coaching. Certain terms will survive termination, including confidentiality and indemnification.

​

14. Confidentiality in Research and Reporting

Coaching session records are confidential and may be shared with Dr. Leit for consultation. Exceptions to confidentiality include legal or ethical obligations to report harm.

15. Scheduling Policy

Clients are responsible for scheduling and canceling appointments using the online system. Late cancellations or no-shows will be charged.

​

16. Self-Assessment Confidentiality

Self-assessment results are confidential and used anonymously for research and reporting purposes.

​

17. Hypnosis

Hypnosis should not replace medical or psychological treatment. HWH assumes no liability for clients' use of hypnosis or self-hypnosis recordings.

​

18. Membership and Cancellation

Membership fees are non-refundable but can be transferred. Members can cancel their subscription by contacting HWH, and automatic renewals will be stopped upon request.

​

19. Course Deposit and Refund Policy

A 50% non-refundable deposit is required for course enrollment. Refunds are available within the first 10 business days, minus the deposit. Students can transfer enrollment or take a leave of absence.

​

20. Merchandise Return Policy

Claims for defective items must be made within 4 weeks. Customers are responsible for return shipping costs if an incorrect address is provided.

​

21. Typographical Errors

HWH reserves the right to correct pricing errors and refund any charges made at incorrect prices.

​

22. Third-Party Links

HWH is not responsible for the content or practices of third-party websites linked on its site.

​

23. Indemnification

Clients agree to indemnify HWH and its representatives from any claims arising from their use of HWH services or violation of these terms.

24. Participation Disclaimer

HWH is not responsible for user-generated content on its website and social media.

​

25. Website Use

Harassment, impersonation, and inappropriate content are prohibited on the HWH website. All content is protected by copyright, and unauthorized use is prohibited.

26. Notice

HWH may deliver notices via email or other reliable methods to the address provided by clients.

​

27. Warranty Disclaimer

HWH materials and services are provided "as is" without warranties. HWH disclaims any liability for errors, viruses, or damages.

​

28. Limitation of Liability

HWH is not liable for any damages resulting from the use of its website or services. Clients' sole remedy is to discontinue use.

​

29. Consent to Participate in Research

Clients participating in research agree to provide truthful information and understand that participation is voluntary.

​

30. Trademarks

HWH trademarks are protected by law, and unauthorized use is prohibited. HWH actively protects its intellectual property rights.

​

31. Limitation to Authorization

Only authorized individuals may use HWH processes and materials. Unauthorized use may result in legal action and loss of certification.

32. Changes to Terms

HWH may update these terms at any time. Continued use of the website or services indicates acceptance of the updated terms.

33. Miscellaneous

The terms are governed by Texas law, and any legal action must be filed within one year. HWH reserves the right to assign its rights and duties under this agreement.

34. Platform and Content Disclaimer

HWH does not guarantee the accuracy or availability of its platform and content. Users are responsible for their use of the platform.

35. Limitation of Liability

HWH's liability is limited to $100 or the amount paid for services. HWH is not liable for any third-party content or interactions.

36. Data Protection and Privacy

Happy Whole Human (HWH) is committed to protecting client data and privacy. We collect, store, and use personal information in accordance with applicable data protection laws, including GDPR and CCPA. Clients' personal data will only be used for purposes related to providing coaching services, research, and improving our offerings. We implement appropriate security measures to protect against unauthorized access, alteration, or disclosure of personal information. Clients have the right to access, correct, or delete their personal data by contacting us at contact@happywholehuman.com.

37. Jurisdiction and Governing Law

These Terms and Conditions are governed by the laws of the State of Texas, USA. Any disputes arising from these terms or the services provided by HWH shall be resolved in the state or federal courts located in Texas. Clients outside of Texas acknowledge and agree that any legal action must be brought in Texas, and they consent to the jurisdiction of Texas courts.

38. Force Majeure

HWH shall not be liable for any failure or delay in performing its obligations under these terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, wars, civil disturbances, and technical failures. In such cases, HWH will make reasonable efforts to resume services as soon as possible.

39. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.

40. Updates and Communication

HWH reserves the right to update these Terms and Conditions at any time. Clients will be notified of any significant changes through email or a notice on our website. Continued use of our services after the changes have been communicated will constitute acceptance of the new terms. Clients are encouraged to review the terms periodically.

41. Client Conduct and Obligations

Clients are expected to participate actively in the coaching process, respect the confidentiality of other clients, and adhere to the guidelines set forth by HWH. Sharing confidential information from coaching sessions with unauthorized parties is strictly prohibited. Clients must also disclose any mental health issues or concerns that may arise during the coaching process.

42. Intellectual Property

All materials provided by HWH, including but not limited to text, graphics, logos, and software, are the intellectual property of HWH or its licensors and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, or distribution of HWH's intellectual property is prohibited. Clients are granted a limited, non-exclusive, non-transferable license to use these materials for personal, non-commercial purposes.

43. Feedback and Dispute Resolution

HWH values client feedback and encourages clients to share their experiences and suggestions. In the event of a dispute, clients agree to first attempt to resolve the issue informally by contacting HWH at contact@happywholehuman.com. If the dispute cannot be resolved informally, the parties agree to submit the dispute to mediation before pursuing legal action.
